Terms of Service

What this site is, what we do, what we are not, and the terms you accept by using it.

Last updated 2026-10-02 · Version 2026-10-02

1. Agreement

By using walldockdeck.com, submitting an enquiry, downloading a guide, requesting a Shore Score or booking an inspection, you accept these Terms.

These Terms incorporate the Privacy Policy, SMS Terms, Messaging Policy, Acceptable Use Policy, Forms & Booking Terms, AI Assistant Notice, Cookie Policy and Copyright & DMCA Policy. Where a separately signed agreement conflicts with these Terms, the signed agreement controls.

If you do not accept these Terms, do not use the site.

2. Definitions

We, us, our — Javill Byron, doing business as Wall Dock Deck.

Site — walldockdeck.com, including the published rule pages, guides, checklists, forms, booking flow and the AI assistant.

You, Owner — a property owner, agent or other person using the Site.

Contractor — an independent licensed marine or general contractor to whom we may refer an enquiry. Contractors are separate businesses. They are not ours.

Enquiry — information you submit through a form, text message or booking request.

Rule Data — the city and county requirements we publish, each with its code section and the date we checked it.

Shore Score — a screening indication of condition and compliance risk, produced from public data and your own answers.

3. Who may use this Site

You must be 18 or older and able to enter a contract. If you submit an enquiry about a property, you confirm that you own it, are authorised to act for the owner, or are a licensed real estate professional acting for a client.

Do not submit someone else's personal information unless you are entitled to share it.

4. What we do, and what we are not

What we do. We publish local waterfront requirements, we publish free guides, and we connect property owners with independent licensed contractors who perform inspections and construction.

What we are not. This matters more than anything else on this page, so it is stated plainly:

  • We are not a licensed marine contractor, general contractor or builder.
  • We are not engineers, and nothing we publish is engineering advice.
  • We are not a permitting consultant, surveyor or expeditor.
  • We are not a law firm, an insurance adviser or a real estate broker.
  • We do not perform inspections, repairs, construction or permitting.

Everything on this Site is general information. It is not legal, engineering, permitting, insurance, financial or professional advice, and it is not a substitute for a licensed professional looking at your property.

How we are paid. We are paid by the contractors in our network, not by you. Using this Site, requesting a guide and receiving a referral are free to you. Being paid by contractors means we have a commercial interest in connecting you with one — you should know that when you weigh what we tell you.

5. The Shore Score and the Rule Data

The Shore Score is a screening, not an inspection. It is produced from public data and the answers you give us. Nobody visits the property to produce it. It cannot tell you whether your seawall is safe, how long it will last, or what a repair will cost. Only a licensed contractor or engineer who inspects the structure can tell you that. Do not make a repair, purchase, sale or insurance decision on a Shore Score alone.

The Rule Data is a compiled reference. We publish each requirement with the code section it came from and the date we checked it. We take that seriously and we do not publish a figure we have not verified. But:

  • Codes change, and a rule verified on the date shown may have changed since.
  • Cities interpret and apply their own codes, and an official at the counter may read a provision differently.
  • A figure stated in one vertical datum is not the same number in another. Always confirm which datum applies.
  • Our summary of a rule is not the rule. The ordinance is the rule.

Confirm with your building department before you rely on anything here, and before you sign a contract or submit a permit application. If you find something wrong, tell us at hello@walldockdeck.com and we will check it and correct it.

6. Acceptable use

You agree not to use the Site to break the law, infringe anyone's rights, upload malware, impersonate anyone, or submit information you are not entitled to share. You agree not to scrape, bulk-download, resell or redistribute the Rule Data or our guides. The Acceptable Use Policy sets this out in full and forms part of these Terms.

Please do not type sensitive information into free-text fields. We do not need, and do not want, your financial account numbers, government identifiers, or health information.

7. Communications and consent

If you give us your email address, we may email you about what you asked for and about your property.

If you give us your phone number and tick the consent box, you agree that we and the contractor partner for your area may contact you by phone, text and email about your property at that number, including by automated means. Consent is never a condition of getting anything from us — every guide, sheet and rule page on this Site is free and ungated.

You can stop our texts at any time by replying STOP. The SMS Terms govern the detail.

One thing to understand clearly: replying STOP stops our messages. It does not reach a contractor who has already received your details. To stop a contractor contacting you, tell that contractor directly — and tell us too, at hello@walldockdeck.com, so we stop referring you.

8. The AI assistant

Parts of this Site, and any text conversation with our published number, may be handled by an automated assistant rather than a person. It will tell you so. It can be wrong. See the AI Assistant Notice for what it does, what it cannot do, and how to reach a human.

Nothing the assistant says is a quote, a commitment, or professional advice, and nothing it says binds us.

9. How we use what you give us

We use your enquiry to answer it, to send you what you asked for, to match you with a suitable contractor, and to improve what we publish. We may use aggregated, de-identified information — which identifies neither you nor your property — to publish market and condition data.

The Privacy Policy governs all of this and explains your rights.

10. Referrals to contractors

This section describes the most important limit on our responsibility. Read it.

We refer. We do not perform. When we pass your enquiry to a contractor, we are introducing you to an independent business. That is the whole of what we do.

We are not a party to anything that follows. Any contract, quote, inspection, payment, permit, warranty or dispute is between you and that contractor. We are not a party to it, we hold no funds, and we do not administer it.

Contractors are independent. They are not our employees, agents, partners, representatives or joint venturers. We do not control, supervise, direct or inspect their work, their crews, their equipment, their scheduling or their pricing. Nothing a contractor says or promises binds us, and a contractor has no authority to speak for us.

We do not guarantee their work. We do not warrant or guarantee any contractor's workmanship, materials, pricing, timeline, estimate, permitting outcome, licensing status, insurance coverage, bonding or conduct.

We check what we can, and that is not everything. We ask contractors in our network to hold the licences and insurance their work requires and to keep them current, and we may remove a contractor who does not. That is a screening step, not a guarantee, and it is not a substitute for your own diligence.

Do your own diligence. Before you sign anything, verify the contractor's licence with the Florida Department of Business and Professional Regulation and the county, confirm their insurance directly with the insurer, get the scope in writing, and get more than one quote. Our free checklists tell you how. Use them.

Disputes. If you have a problem with a contractor, raise it with them. Tell us as well — we want to know, and it affects whether they stay in our network — but we cannot resolve a dispute between you and an independent business, and we are not liable for it.

11. Security

We use commercially reasonable administrative, technical and organisational measures to protect the information you give us. The Security Overview describes them.

No method of transmission or storage is perfectly secure and we cannot guarantee absolute security. If a security incident affects your personal information, we will notify you as required by law, including Florida Statutes § 501.171.

12. Privacy

The Privacy Policy explains what we collect, why, who we give it to, and how to make us stop. Your state-law choices, including the right to opt out of our disclosure of your information to contractors, are at Your Privacy Choices.

13. Third parties

The Site links to city and county pages, state agencies and other third-party resources. We do not control them, we are not responsible for their content or accuracy, and a link is not an endorsement.

We use third-party service providers to run the Site and to deliver messages. They are listed at Service Providers.

14. Intellectual property

We own the Site, the brand, the guides, the checklists, the Shore Score methodology, and the selection, arrangement, annotation and dating of the Rule Data.

The underlying ordinances are government edicts and nobody owns them. Our compilation of them — which rules we chose, how we arranged them, what we added, and the verification dates — is ours.

You may read, print and share our guides for your own non-commercial use, with attribution. You may not resell them, republish them, strip our attribution, bulk-download or scrape the Rule Data, or use any of it to build a competing database.

If you send us feedback, we may use it freely, with no obligation or payment to you.

15. Availability and changes to the Site

We provide the Site as is and as available. We may change, add, remove or discontinue any part of it, including any page, guide or figure, at any time. We do not guarantee the Site will be available or uninterrupted.

Response times. Where we state how quickly we will respond to an enquiry, that is a target, not a guarantee.

16. Disclaimers

THE SITE, THE RULE DATA, THE GUIDES, THE SHORE SCORE AND ALL REFERRALS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE RULE DATA IS CURRENT, COMPLETE OR CORRECT FOR YOUR PROPERTY, THAT A SHORE SCORE REFLECTS THE ACTUAL CONDITION OF ANY STRUCTURE, OR THAT ANY CONTRACTOR WILL PERFORM.

We are not a licensed contractor, not an engineer, not a surveyor, not a permitting consultant, not a law firm, not an insurance adviser and not a real estate broker. Nothing on this Site is professional advice of any kind.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF USE, OR DIMINUTION IN PROPERTY VALUE, HOWEVER CAUSED.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR A REFERRAL IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) ONE HUNDRED U.S. DOLLARS.

WE ARE NOT LIABLE FOR THE ACTS, OMISSIONS, WORK, PRICING, DELAY, DAMAGE OR CONDUCT OF ANY CONTRACTOR, OR FOR ANY DECISION YOU MAKE IN RELIANCE ON THE RULE DATA OR A SHORE SCORE.

Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud, or for death or personal injury caused by negligence. Some states do not allow certain exclusions, so some of the above may not apply to you.

18. Suspension and removal

We may decline to publish, refuse an enquiry, decline to refer you, remove content, or stop providing the Site to you, at our discretion, including where we believe the Site is being misused.

We may remove a contractor from our network at any time, including for a lapsed licence or insurance, complaint volume, or conduct toward referred owners.

19. Indemnification

You will indemnify and hold us harmless from third-party claims arising from information you submit that you were not entitled to share, your misuse of the Site, your infringement of our or anyone's intellectual property, or your breach of these Terms.

This does not apply to a claim arising from our own negligence or misconduct. We will give you prompt notice of any claim, you may control the defence with counsel we reasonably approve, and you will not settle anything that imposes an obligation on us without our written consent.

20. Changes to these Terms

We may change these Terms. If a change is material we will post the updated version with a new date and, where we have your email address, tell you at least 14 days before it takes effect. Continuing to use the Site after the effective date means you accept the change.

21. Governing law and disputes

These Terms are governed by the law of the State of Florida, without regard to its conflict-of-laws rules.

The exclusive venue for any dispute is the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

Jury trial waiver. To the maximum extent permitted by law, each party waives any right to a jury trial.

Class action waiver. To the maximum extent permitted by law, each party may bring claims only in its individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding.

Time limit. Any claim relating to the Site or a referral must be brought within one year of when it arose, except where a longer period is required by law.

Try us first. Before filing anything, email hello@walldockdeck.com with the problem. Most things can be fixed without lawyers, and we would rather fix them.

22. General

Independent parties. Nothing here creates an agency, partnership, employment or joint venture between you and us, or between us and any contractor.

Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.

Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including storms, hurricanes, flooding and acts of government.

Severability. If a provision is unenforceable, the rest stays in force.

No waiver. Failing to enforce a provision is not a waiver of it.

Notices. We may give notice by email or by posting on the Site. You consent to receiving communications and records electronically.

Entire agreement. These Terms and the documents they incorporate are the entire agreement between us about the Site.

Survival. Sections 4, 5, 10, 14, 16, 17, 19, 21 and 22 survive termination.
