A signed document in which a contractor, subcontractor or supplier gives up lien rights for work covered by a payment. Section 713.20, Florida Statutes, sets out two forms: a waiver and release upon progress payment, and one upon final payment. A lienor can be required to sign one in exchange for, or to induce, a payment, and no one may require a waiver in a different form. A right to a lien may not be waived in advance, so a release covers money paid, not future work. A lienor may make the release conditional on the check clearing. Collect one from each party who sent you a Notice to Owner, with every payment.
