Seller's seawall information checklist

A buyer's inspector, engineer and lender will all ask about the seawall, usually inside a short inspection period. Having the answers ready keeps the conversation about price rather than about missing paperwork. This is a list of information to gather. It is not a disclosure form, and it does not tell you what you are legally required to disclose.

This is a template, not legal advice. Have an attorney review anything you sign or send in a dispute.

Before you use it

What you must disclose is a separate questionThat depends on Florida law, your contract and your city. Ask your listing agent and your attorney. This checklist only helps you find the facts.
Some cities set their own wordingDelray Beach, for example, requires sale contracts for property in tidally influenced areas to carry a specific tidal flood barrier disclosure (Land Development Regulations Sec. 7.1.7; Ordinance 23-21). See the Delray Beach page.
Pull the permit historyIf you do not have the permits, the city does. Use our public records request.
Give the elevation with its datumA cap height without the datum and the survey it came from cannot be checked. Quote it as the survey gives it; do not convert between datums yourself.
