Florida's permit for activities that alter surface water flows or involve dredging and filling in wetlands and other surface waters, issued under Part IV of Chapter 373, Florida Statutes. The Florida Department of Environmental Protection says applications go to one of its district offices or to a water management district, and that DEP generally handles docking facilities that are not part of a larger residential or commercial development, and systems serving a single-family home. Some work is exempt under s. 403.813(1), including restoring a seawall at its previous location, upland of it, or within 18 inches waterward of it, and repairing or replacing a dock within 5 feet of the same location with no increase in size. An exemption does not remove the need for state consent to use sovereign submerged lands.
